Booking System Terms & Conditions
Please read these Terms carefully before you use this Online Booking System as they affect your rights and liabilities under the law. By using this Online Booking System and any service contained within, you indicate that you accept these Terms in full and you agree to abide by them. If you do not fully agree to these Terms, please do not register for or use our Online Booking System.
THESE TERMS DO NOT AFFECT YOUR STATUTORY RIGHTS
1. User Information
1.1. The Online Booking System is provided to you free of charge for your personal use subject to these Terms.
1.2. The Online Booking System is owned and operated by Essex Cares Limited, trading as ECL (Company Number: 06723149) a limited company registered in England and Wales, whose registered office is at Seax House, Victoria Road South, Chelmsford, Essex, CM1 1QH (“ECL”).

1.5. All Bookings made through this Online Booking System will be charged at the advertised rate. Users must register for use of the Online Booking System providing all required details in order to make a booking. Bookings must be made using this registered user name.
1.6. All financial transactions will be processed by WorldPay.
1.7. You should always check that the contact information you provide is correct before registering for use of this Online Booking System, or proceeding to payment. You must inform us immediately of any changes to the information that you have provided by updating your personal details on your online account.
1.8. Our Online Booking System is only intended for use by adults aged 18 and over.
1.9. We reserve the right to restrict or remove your access to this Online Booking System should you breach these Terms. Such restriction or removal will take place without recourse or explanation to you where we solely deem it appropriate or necessary.
2.1. We may update these Terms from time to time and any changes will be published on our Online Booking System. The changes will apply to the use of our Online Booking System after we have given such notice.
2.2. If you do not wish to accept the new Terms you should not continue to use our Online Booking System. If you continue to use the Online Booking System after the date on which the change comes into effect, your use of the Online Booking System indicates your agreement to be bound by any change to the Terms.
3. Password and security
3.1. If you choose to register to use our Online Booking System you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and Bookings that are made using your username. If you are aware or suspect that your username and password or other details have become known to a third party, you should inform us immediately, and you should change your password immediately.
3.2. If we have reason to believe that there is likely to be a breach of security or misuse of our Online Booking System, we may suspend or disable your account in accordance with paragraph 8 below.
4. Bookings and Refunds
4.1. All bookings are non refundable.
4.2. If a booking is cancelled with more than 24 hours notice then a credit to the value of the booking shall be applied to the Users account for use when making a future booking.
4.3. If a booking is cancelled with less than 24 hours notice then no credit shall be given.

6. Intellectual property
6.1. The content of our Online Booking System is protected by copyright, trade marks, database and other intellectual property rights and all such rights are reserved. We are the owner or the licensee of all such rights, unless expressly acknowledged as otherwise.
6.2. You may retrieve and display the content of our Online Booking System on a computer screen, store such content in electronic form on disk or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.
6.3. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes in any way, any of the materials or content on our Online Booking System and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. The authors and contributors of material on this Online Booking System must always be acknowledged.
6.4. No licence is granted to you in these Terms to use any of our or our affiliated companies’ trademarks or other intellectual property rights.
7. Availability of Online Booking System
7.1. Although we aim to offer you the best service possible, we make no promise that the services on our Online Booking System will meet your requirements. We cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it by email (ECL.ContactCentre@essexcares.org) and we will attempt to correct the fault as soon as we reasonably can.
7.2. Your access to our Online Booking System may be occasionally withdrawn or restricted without notice, to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can. We will not be liable if for any reason our Online Booking System is unavailable at any time or for any period.
8. Right to suspend or cancel your registration
8.1. We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms.
8.2. The suspension or cancellation of your registration and your right to use our Online Booking System shall not affect either party's rights or liabilities.
8.3. Paragraphs 6, 7 and 10 of these Terms shall survive cancellation of your registration.
9. Bookings liability
9.1. We provide our Online Booking System without any warranties, conditions or guarantees as to its accuracy. You must bear the risks associated with the use of the internet.
9.2. While we try to ensure that material included on our Online Booking System is correct, reputable and of high quality, we do not accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with our Online Booking System. If we are informed of any inaccuracies in the material on this Online Booking System we will attempt to correct the inaccuracies as soon as we reasonably can.
9.3. Please note that, in particular, we will not be liable for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising out of or in connection with:
9.3.1. use of or inability to use the Online Booking System;
9.3.2. reliance upon the Online Booking System or any of its content; or
9.3.3. a security breach of the Online Booking System.
9.4. We make no guarantees that the Online Booking System is free from computer viruses. It is strongly recommended that you check for such viruses before using the Online Booking System or any of its contents.
10. Data Protection
11.1. We reserve the right to assign our rights and also our obligations under these Terms, without giving notice to you. You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
11.2. If you breach these Terms and we ignore the breach, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms.
11.3. Nothing in these Terms shall confer on any third party any benefit or the right to enforce any of these Terms.
12.1. We reserve the right to vary these Terms at any time, without giving notice to you. Such varied Terms shall automatically apply to the use of our Online Booking System from the date of publication on our Online Booking System.
13. Force Majeure
13.1. We shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure is caused by any circumstances that are beyond our reasonable control, including but not limited to acts of god, war, civil disorder or industrial dispute.
14.1. The foregoing paragraphs, sub-paragraphs and clauses of these Terms shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.
15.1. These Terms shall be interpreted, construed and enforced in accordance with the Law of England and Wales and any disputes connected with these Terms shall be subject to the exclusive jurisdiction of the English courts in connection with any dispute hereunder.
